Terms of Use
These terms (the “Terms”) govern your use of all websites and mobile content operated by Aviso Wealth Inc. (“Aviso”) (individually referred to as a “Website” and collectively referred to as the “Websites”). If you access and use the Websites, you accept and agree to be bound by and comply with the Terms and any terms, conditions, legal notices and disclaimers in the footers, content, other pages of the Websites and behind links, buttons or icons on the Websites (the “Additional Terms”).
The Terms and Additional Terms also apply when you use a downloadable application or other technology to access any features, functionality, content and/or information that is made available or provided on the Websites.
Aviso is a wholly owned subsidiary of Aviso Wealth LP, which in turn is owned 50% by Desjardins Financial Holding Inc. and 50% by a limited partnership owned by the five Provincial Credit Union Centrals and The CUMIS Group Limited. The following entities are subsidiaries of Aviso: Aviso Financial Inc. (including Aviso Wealth, Qtrade Direct Investing, Qtrade Guided Portfolios and Aviso Correspondent Partners), Credential Insurance Services Inc., Aviso Insurance Inc. and Northwest & Ethical Investments L.P (collectively, the “Aviso Companies”). The Aviso Companies make their services available online and at branches of credit unions and other financial services organizations across Canada.

The information, material and content provided in the pages of the Websites (the “Information”) is believed to be reliable when posted, but is not guaranteed to be current, accurate or complete at all times. Any expressed views or opinions provided on the Websites do not imply endorsement.
Changes may be made to the Terms and Additional Terms at any time without notice by updating this Website. You agree to review the Terms and Additional Terms regularly, and your continued access or use of the Websites will mean that you agree to any changes.
The Websites, Information, Terms and Additional Terms will be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, notwithstanding your residence or physical location. All disputes, controversies or claims arising out of or in connection with the Websites, Information, Terms or Additional Terms will be submitted to and be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
No Advice
The Information is for general reference only. You should not rely on it for specific financial, investment, tax, legal, accounting or other advice. Persons accessing the Information are advised to seek the advice of a professional where appropriate.
No Solicitation
The Information does not constitute an offer or solicitation to buy or sell any product, service or security to anyone in the United States or any other jurisdiction in which such an offer or solicitation is not authorized or to any person to whom it is unlawful to make such an offer or solicitation. The Websites are intended for Canadian residents only.
No Warranties
Aviso provides the Websites and the Information on an “as is, where is” basis and does not make any express or implied warranties, representations or endorsements with respect to the Websites or the Information, including, without limitation, warranties as to merchantability, operation, non-infringement, usefulness, completeness, accuracy, reliability and fitness for a particular purpose. Further, Aviso does not represent or warrant that the Websites will be available to meet your requirements, that access will be uninterrupted, that there will be no delays, difficulties in use, defects, incompatibility, failures, errors, omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. Aviso is not responsible in any way for any damages (direct, indirect, special, economic, punitive or consequential) in respect of the use of the Websites and any Information, your ability or inability to access the Websites or Information, any action or decision made by you or anyone else in reliance on the Websites or Information, or any unauthorized use or reproduction or the Websites or Information.
Important Mutual Fund Information
Mutual funds and other securities are offered through Aviso Wealth, Qtrade Direct Investing, Qtrade Guided Portfolios and Aviso Correspondent Partners. Commissions, trailing commissions, management fees and expenses all may be associated with mutual fund investments and the use of an asset allocation service. Important information about a mutual fund is contained in its simplified prospectus and/or Fund Facts sheet. Please consult your financial advisor and read the prospectus and/or Fund Facts carefully before investing. Unless otherwise stated, cash balances, mutual funds and other securities are not covered by the Canada Deposit Insurance Corporation or any other government deposit insurer that insures deposits in financial institutions. Mutual funds and other securities are not guaranteed, their values change frequently and past performance may not be repeated. Aviso Financial Inc. is a Member of the Canadian Investor Protection Fund. NEI Funds are principally distributed by Aviso Financial Inc. The NEI Funds and the units thereof are not registered with the United States Securities and Exchange Commission and they are sold in the United States only in reliance on exemptions from registration.
Currency
Unless otherwise specified, the currency used throughout the Websites is in Canadian dollars.
Information Provided by You
You agree that any information or materials that you provide to any of the Aviso Companies through any of the Websites shall become the sole property of Aviso, and may be used freely by any Aviso Company. By providing such information and materials, you declare and warrant that you have all necessary rights to submit such information and materials and that the information and material do not infringe the rights of third parties.
Electronic Communication via the Internet
Any unprotected electronic communication over the Internet is, as with communication via other mediums (e.g., cellular phones, post office mail and social media pages) not secure and privacy cannot be assured. Unprotected electronic communications are not confidential, and may be subject to interruption, loss or alteration. You should not send any confidential, proprietary or sensitive information about you or others via these mediums. Aviso is not responsible for and will not be liable to you or anyone else for any damages in connection with an email or any other electronic message sent by you to an Aviso Company, or an email or any other electronic message sent by an Aviso Company to you at your request.
Third-Party Links/Software
Links from or to other websites, including links to the Websites, are for convenience only. Aviso does not review or control, and is not responsible for, any websites linked from or to the Websites, the content of those websites, the privacy practices of those websites, the third parties named therein, or their products or services. Links to other websites or references to products, services or publications do not imply the endorsement or approval of such websites, products, services or publications by Aviso. No liability is assumed for incapability, non-sustainability, viral infection, worms, Trojan horses, or other destructive/disruptive components on or from such sites. Linking to another website is at your sole risk and Aviso is not responsible or liable for any damages in connection with linking.
You may not gather, extract, reproduce and/or display on any other non-Aviso website or other online service, any material on or from the Websites, whether or not by the use of spiders or other ‘screen scraping’ software or system used to extract data without the express consent of Aviso.
If you download any software, Aviso is not responsible or liable for any difficulties or consequences associated with downloading such software. The use of any downloaded software is governed by the terms of the applicable licence agreement, if any, which accompanies such software or is provided with such software or herein.
The following terms apply if you download a software application that an Aviso Company offers to access any services, features, functionality, content and/or information made available by an Aviso Company using certain mobile devices (the “Software”):
- Aviso grants to you a non-exclusive and non-transferable licence for the Software. The license authorizes you to use the Software in object code format for the purpose of using the online services of the Aviso Companies (“Online Services”) and/or accessing any services, features, functionality, content and/or information made available by any Aviso Company using certain mobile devices;
- Aviso retains at all times all ownership rights, including without limitation, copyright, in the Software. You agree not to copy the Software and not to disclose or distribute the Software to third parties. Aviso has no obligation to provide any training, maintenance, or other assistance for the Software;
- You accept the software “as is” and assume the entire risk for the performance of the software. Aviso and any other Aviso Company will not be liable to you for any damages resulting from your use of the software, under these terms or otherwise; and
- Aviso may end these software terms at any time on notice to you. On the ending of these terms, you will destroy or return all copies of the Software or of any documentation for it then in your possession. The grant of the license may not be assigned by you unless agreed upon in writing by Aviso.
Mobile Services
The following terms apply if you access Online Services using certain mobile devices through Websites specifically designed for mobile devices or through the Software (“Mobile Services”):
- You must be enrolled in the Online Services of the specific Aviso Company in order to use the Mobile Services of that Aviso Company;
- You will not have access to all of the same services, features, functionality, content or information through Mobile Services as you may through Online Services (including your online message centre, notices, legal and privacy terms, links, bills, statements and complete transaction and account information) and you must access Online Services through a technology other than Mobile Services on a regular basis to access the services, features, functionality, content and information of such Online Services;
- There may be important terms and conditions that are displayed only when you click on information icons or links within Mobile Services. You must access and read those terms and conditions, and by using Mobile Services, those terms and conditions apply to your use of Mobile Services, in addition to the terms and conditions of any applicable agreements; and
- Mobile Services may not be available for use in locations outside of Canada and the United States; and
- You are responsible for any fees imposed by a service provider that you might incur by accessing Mobile Services.
Social Media
Aviso’s social media postings and content are intended for Canadian residents only. Aviso uses social media for informational purposes only to provide information on Aviso products and services, educational content, financial news and insights. Aviso may occasionally re-publish third-party content or links that we believe are related to the investment management industry that may be of interest to financial advisors and/or investors. All content published by Aviso on any social media channel is not intended to provide specific advice including, without limitation, investment and tax or similar matters. Aviso endeavours to ensure that the contents have been compiled or derived from sources that we believe are reliable and contain information that is accurate and complete. However, Aviso makes no representation or warranty, express or implied, in respect thereof, and takes no responsibility for any errors and omissions contained therein.
While all social media channels encourage information sharing and conversation, users should not disclose personal information for security and privacy reasons. Users should not post inappropriate, disrespectful, inaccurate or unrelated content. Aviso reserves the right to delete inappropriate, disrespectful, inaccurate or unrelated content posted on its social media channels. Aviso is not affiliated with any social media website and cannot control how they or other parties will use the information you share on it. Intellectual Property
Certain names, words, titles, phrases, logos, icons, graphics or designs found on the Websites or other websites accessed therefrom may constitute trade names, trademarks or other intellectual property, either registered or unregistered of Aviso, any of its member companies, their respective affiliates or of third parties and used under license by Aviso. You do not have permission to copy, redistribute, reproduce or republish, in any form, any such information or property found on the Websites. Any services, products, processes or technology described on the Websites may be the subject of other intellectual property rights reserved by Aviso, any of its member companies, their respective affiliates or licensors, and are not licensed hereunder. Any unauthorized downloading, retransmission, or other copying or modification of any intellectual property or other contents of the Websites may be a violation of statutory or common law rights which could subject the violator to legal action.
Best Execution Policy and Multiple Marketplace Disclosure
Canadian and U.S. rules and regulations allow a security to trade on more than one marketplace. Since different markets may have different rules and features, Aviso Financial Inc. has taken steps to achieve best execution of client orders.
