Legal Terms of Use

These terms (the “Terms”) govern your use of all websites and mobile content operated by Credential Financial Inc. (“Credential”) or its subsidiaries (together with Credential, the “Credential Companies”) (individually referred to as a “Website” and collectively referred to as the “Websites”). If you access and use the Websites, you accept and agree to be bound by and comply with the Terms and any terms, conditions, legal notices and disclaimers in the footers, content, other pages of the Websites and behind links, buttons or icons on the Websites (the “Additional Terms”).

The Terms and Additional Terms also apply when you use a downloadable application or other technology to access any features, functionality, content and/or information that is made available or provided on the Websites.

Credential Asset Management Inc., Credential Insurance Services Inc., Credential Financial Strategies Inc. and Credential Securities Inc. (and Credential Direct® and Credential Correspondent Partners) are subsidiaries of Credential. Credential is owned by five provincial credit union centrals and The CUMIS Group Limited. The Credential Companies make their services available at branches of credit unions and other financial services organizations across Canada.

General

The information, material and content provided in the pages of the Websites (the “Information”) is believed to be reliable when posted, but is not guaranteed to be current, accurate or complete at all times. Any expressed views or opinions provided on the Websites do not imply endorsement.

Changes may be made to the Terms at any time without notice by updating this Website. You agree to review the Terms regularly, and your continued access or use of the Websites will mean that you agree to any changes.

The Websites, Information, Terms and Additional Terms will be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, notwithstanding your residence or physical location. All disputes, controversies or claims arising out of or in connection with the Websites, Information, Terms or Additional Terms will be submitted to and be subject to the exclusive jurisdiction of the courts of the Province of British Columbia.

No Advice

The Information is for general reference only. You should not rely on it for specific financial, investment, tax, legal, accounting or other advice. Persons accessing the Information are advised to seek the advice of a professional where appropriate.

No Solicitation

The Information does not constitute an offer or solicitation to buy or sell any product, service or security to anyone in the United States or any other jurisdiction in which such an offer or solicitation is not authorized or to any person to whom it is unlawful to make such an offer or solicitation. The Websites are intended for Canadian residents only.

No Warranties

Credential provides the Websites and the Information on an “as is, where is” basis and does not make any express or implied warranties, representations or endorsements with respect to the Websites or the Information, including, without limitation, warranties as to merchantability, operation, non-infringement, usefulness, completeness, accuracy, reliability and fitness for a particular purpose. Further, Credential does not represent or warrant that the Websites will be available to meet your requirements, that access will be uninterrupted, that there will be no delays, difficulties in use, defects, incompatibility, failures, errors, omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for taking protection and backup of data and/or equipment and for taking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.

Disclaimer of Liability

Credential is not responsible in any way for any damages (direct, indirect, special, economic, punitive or consequential) in respect of the use of the Websites and any Information, your ability or inability to access the Websites or Information, any action or decision made by you or anyone else in reliance on the Websites or Information, or any unauthorized use or reproduction or the Websites or Information.

Important Mutual Fund Information

Mutual funds are offered through Credential Asset Management Inc., and mutual funds and other securities are offered through Credential Securities Inc. Commissions, trailing commissions, management fees and expenses all may be associated with mutual fund investments and the use of an asset allocation service. Important information about a mutual fund is contained in its simplified prospectus and/or Fund Facts sheet. Please consult your financial advisor and read the prospectus carefully before investing. Unless otherwise stated, cash balances, mutual funds and other securities are not covered by the Canada Deposit Insurance Corporation or any other government deposit insurer that insures deposits in financial institutions. NEI Funds, Northwest Funds and Ethical Funds are principally distributed by Credential Asset Management Inc. The NEI Funds, Northwest Funds and Ethical Funds and the units of thereof are not registered with the United States Securities and Exchange Commission and they are sold in the United States only in reliance on exemptions from registration.

Currency

Unless otherwise specified, the currency used throughout the Websites is in Canadian dollars.

Information Provided by You

You agree that any information or materials that you provide to any of the Credential Companies through any of the Websites shall become the sole property of Credential, and may be used freely by any Credential Company. By providing such information and materials, you declare and warrant that you have all necessary rights to submit such information and materials and that the information and material do not infringe the rights of third parties.

Electronic Communication via the Internet

Any unprotected electronic communication over the Internet is, as with communication via other mediums (e.g., cellular phones, post office mail and social media pages) not secure and privacy cannot be assured. Unprotected electronic communications are not confidential, and may be subject to interruption, loss or alteration. You should not send any confidential, proprietary or sensitive information about you or others via these mediums. Credential is not responsible for and will not be liable to you or anyone else for any damages in connection with an email or any other electronic message sent by you to a Credential Company, or an email or any other electronic message sent by a Credential Company to you at your request.

Third Party Links/Software

Links from or to other websites, including links to the Websites, are for convenience only. Credential does not review or control, and is not responsible for, any websites linked from or to the Websites, the content of those websites, the privacy practices of those websites, the third parties named therein, or their products or services. Links to other websites or references to products, services or publications do not imply the endorsement or approval of such websites, products, services or publications by Credential. No liability is assumed for incapability, non-sustainability, viral infection, worms, Trojan horses, or other destructive/disruptive components on or from such sites. Linking to another website is at your sole risk and Credential is not responsible or liable for any damages in connection with linking.

You may not gather, extract, reproduce and/or display on any other non-Credential website or other online service, any material on or from the Websites, whether or not by the use of spiders or other ‘screen scraping’ software or system used to extract data without the express consent of Credential.

If you download any software, Credential is not responsible or liable for any difficulties or consequences associated with downloading such software. The use of any downloaded software is governed by the terms of the applicable licence agreement, if any, which accompanies such software or is provided with such software or herein.

The following terms apply if you download a software application that a Credential Company offers to access any services, features, functionality, content and/or information made available by a Credential Company using certain mobile devices (the “Software”):

  • Credential grants to you a non-exclusive and non-transferable licence for the Software. The license authorizes you to use the Software in object code format for the purpose of using the online services of the Credential Companies (“Online Services”) and/or accessing any services, features, functionality, content and/or information made available by any Credential Company using certain mobile devices.
  • Credential retains at all times all ownership rights, including without limitation, copyright, in the Software. You agree not to copy the Software and not to disclose or distribute the Software to third parties. Credential has no obligation to provide any training, maintenance, or other assistance for the Software.
  • YOU ACCEPT THE SOFTWARE “AS IS” AND ASSUME THE ENTIRE RISK FOR THE PERFORMANCE OF THE SOFTWARE. CREDENTIAL AND ANY OTHER CREDENTIAL COMPANY WILL NOT BE LIABLE TO YOU FOR ANY DAMAGES RESULTING FROM YOUR USE OF THE SOFTWARE, UNDER THESE TERMS OR OTHERWISE. 
  • Credential may end these software terms at any time on notice to you. On the ending of these terms, you will destroy or return all copies of the Software or of any documentation for it then in your possession. The grant of the license may not be assigned by you unless agreed upon in writing by Credential.

Mobile Services

The following terms apply if you access Online Services using certain mobile devices through Websites specifically designed for mobile devices or through the Software (“Mobile Services”):

  • You must be enrolled in the Online Services of the specific Credential Company in order to use the Mobile Services of that Credential Company;
  • You will not have access to all of the same services, features, functionality, content or information through Mobile Services as you may through Online Services (including your online message centre, notices, legal and privacy terms, links, bills, statements and complete transaction and account information) and you must access Online Services through a technology other than Mobile Services on a regular basis to access the services, features, functionality, content and information of such Online Service;
  • There may be important terms and conditions that are displayed only when you click on information icons or links within Mobile Services. You must access and read those terms and conditions, and by using Mobile Services, those terms and conditions apply to your use of Mobile Services, in addition to the terms and conditions of any applicable agreements;
  • Mobile Services may not be available for use in locations outside of Canada and the United States; and
  • You are responsible for any fees imposed by a service provider that you might incur by accessing Mobile Services. Trademarks

No reproduction, transmission, storage, retrieval, translation or transcription of the Information in any form or by any means is permitted in whole or in part without the express written consent of Credential.

Unclaimed Property

Under the Unclaimed Property Act of British Columbia and equivalent legislation in other provinces and territories, the Credential Companies are required to make reasonable efforts to reunite clients with their unclaimed property.

Accounts exceeding the minimum prescribed value of $200.00 for residents of British Columbia will generally be considered "unclaimed" in the following instances:

  • A communication or cheque sent to a client is returned as undeliverable;
  • A communication has been sent to a client requiring action to be taken by the client by a specified date, and no action has been taken;
  • A cheque issued in the name of a client remains uncashed after three (3) years; or
  • There has been no account activity and a client has not made any attempts to contact Credential or its agents within the past three (3) years.

Credential will make reasonable efforts to locate owners for whom it is holding unclaimed property. If we are unsuccessful in locating an owner, the unclaimed property will be recorded and maintained in a secure database.
